보건복지부는 노인복지주택 입소자의 권익을 보호하기 위해 ‘노인복지법’ 시행규칙 개정안을 10월 13일부터 11월 23일까지 입법예고합니다. 지금은 노인복지주택 입소자를 단독취사 등 독립된 주거 생활을 하는 60세 이상으로 정하고 있습니다. 개정안은 입소자가 사는 동안 건강이 나빠지더라도 장기요양급여 등 복지부 장관이 정하는 서비스를 받아 독립생활이 가능하면 계속 살 수 있도록 했습니다. 입소자 과반수 이상이 동의하면 입소자대표회의를 만들어 시설 운영에 의견을 낼 수 있습니다. 운영자가 없거나 역할을 사실상 하지 못하는 경우에는 이 회의가 제한적으로 운영자 역할을 대신할 수 있습니다. 아직은 개정안이며, 복지부는 의견을 모은 뒤 확정할 예정입니다.
Translation
To better protect the rights of residents of senior welfare housing, the Ministry of Health and Welfare is giving advance notice of a draft amendment to the enforcement rules of the 노인복지법 (the law on welfare for older people), from October 13 to November 23. At present, the rules limit residents of senior welfare housing to people aged 60 or older who live independently, such as by cooking for themselves. Under the amendment, residents whose health gets worse while living there can keep living there if they can still live independently with services set by the Minister of Health and Welfare, such as long-term care benefits. If more than half of the residents agree, they can set up a residents' representative council and give their opinions on how the facility is run. If there is no operator, or the operator is effectively unable to do the job, this council can take on the operator's role to a limited extent. It is still a draft, and the ministry plans to finalize it after collecting opinions.
