Korea Moves to Give Regulators Emergency Power to Cut Single-Stock Leverage Multiplier

금융위원회와 금융감독원은 증시가 급변할 때 시장 안정화 조치를 취할 수 있도록 하는 자본시장법 개정안 마련에 착수했습니다. 핵심은 현재 2배로 고정된 단일종목 레버리지 상품의 배율을 당국이 직접 낮출 수 있게 하는 ’긴급조치권’을 새로 확보하는 것입니다. 수익자 이익과 관련된 사안은 수익자총회를 거쳐야 한다는 해석에 따라 당국이 배율을 단기간에 조정하기 어렵다는 지적이 그동안 제기됐습니다. 당국은 앞서 7월 31일부터 기본예탁금을 1000만 원에서 3000만 원으로 올리는 1차 보완대책을 시행했습니다. 그 결과 시행 첫날 단일종목 레버리지 16개 종목의 거래대금은 전날 12조 4000억 원에서 약 3조 원으로 줄었습니다. 당국은 법 개정을 추진하는 한편 계좌별 투자한도 설정과 모의거래 의무화도 검토하고 있습니다.
Translation
The Financial Services Commission and the Financial Supervisory Service have begun preparing an amendment to the Capital Markets Act that would let market-stabilising measures be taken when the stock market swings sharply. At its core is securing a new "emergency power" that would allow the authorities to directly lower the multiplier on single-stock leverage products, currently fixed at two times. Under the interpretation that matters affecting beneficiaries' interests must go through a meeting of beneficiaries, it has been pointed out all along that the authorities cannot adjust the multiplier at short notice. Earlier, from 31 July, the authorities put into effect a first round of supplementary measures raising the minimum deposit from 10 million won to 30 million won. As a result, on the first day of implementation the trading value of the 16 single-stock leverage issues fell from 12.4 trillion won the previous day to about 3 trillion won. While pushing ahead with the legal amendment, the authorities are also reviewing per-account investment caps and mandatory simulated trading.
