국회 법제사법위원회 소속 진보당 손솔 의원이 대법원 제출자료와 개인회생 신청 대리인 설문조사를 분석한 결과입니다. 개인회생 신청부터 개시결정까지 평균 기간은 서울회생법원 5.2개월, 부산회생법원 8.1개월, 의정부지방법원 12.1개월로, 부산과 의정부는 서울보다 각각 2.9개월, 6.9개월 길었습니다. 접수 대비 인가 비율도 서울 74.3%, 부산 55.9%, 의정부 41.0%로 차이가 컸습니다. 5천만 원의 채무가 있는 40대 남성을 가정할 경우, 평균 변제율 서울 36.70%, 부산 42.17%, 의정부 47.33%를 단순 적용하면 서울과 의정부의 차이는 약 531만 원입니다. 대리인 32명 설문에서는 복수 법원에서 사건을 맡은 23명 가운데 21명(91.3%)이 법원에 따라 처리 기간에 차이가 있다고 답했습니다. 현장에서는 유리한 조건을 찾아 거주지나 직장을 옮기는 사례까지 있다는 지적도 나왔습니다.

This is the result of an analysis by 손솔 (Son Sol), a Progressive Party member of the National Assembly's Legislation and Judiciary Committee, of data submitted by the Supreme Court and a survey of agents who file personal rehabilitation applications. The average time from applying for personal rehabilitation to the decision to open proceedings was 5.2 months at the Seoul Rehabilitation Court, 8.1 months at the Busan Rehabilitation Court and 12.1 months at the Uijeongbu District Court, so Busan and Uijeongbu took 2.9 and 6.9 months longer than Seoul. The ratio of approvals to applications also differed widely: 74.3% in Seoul, 55.9% in Busan and 41.0% in Uijeongbu. If you assume a man in his 40s with debts of 50 million won and simply apply each court's average repayment rate — 36.70% in Seoul, 42.17% in Busan and 47.33% in Uijeongbu — the difference between Seoul and Uijeongbu comes to about 5.31 million won. In a survey of 32 agents, 21 (91.3%) of the 23 who had handled cases at more than one court said processing times differed by court. People in the field also pointed out that there are even cases of people moving their home or workplace in search of better conditions.
