The Ministry of Land, Infrastructure and Transport announced that amendments to the enforcement decrees of the Framework Act on the Construction Industry and the Saemangeum Project Act were approved at the Cabinet meeting on 15 September. The construction-industry amendment lets the minister impose administrative sanctions directly for serious illegal subcontracting on building sites, and newly provides for reduced sanctions for those who report it themselves. Until now, illegal subcontracting had to be sanctioned within six months of detection, but the power to do so lay with local governments; from now on the ministry will act directly in cases set out by public notice, taking into account who detected it, the subcontract amount, the type of work and the stage of construction. If a firm reports its illegal subcontracting within the period the minister sets by notice and completes corrective action before the sanction is finalised, a business suspension or fine can be reduced by up to one half. This amendment takes effect four months after promulgation. The Saemangeum amendment adds construction engineering service contracts to the areas where the project operator may favour local firms and changes the way developed land is supplied to competitions based on project proposals, designs and plans; it took effect on the day of promulgation.
